This seminar provides an in-depth forum for academics, practitioners, authorities and policymakers to explore the evolving legal, economic and policy framework governing State aid, more specifically the current status of interpretation of the basic State aid criteria. Against the backdrop of recent case law, Commission practice, and broader debates, the seminar will examine both the conceptual underpinnings as well as the practical application of the State aid criteria and related concepts, such as:
- Economic advantage
- State resources and imputability
- Selectivity
- Notion of undertaking
- Distortion of competition and affectation of trade
Special attention will be devoted to their original interpretation as well as evolution through the case law. By combining analytical perspectives with hands-on discussion, the seminar aims not only to deepen participants’ understanding of the State aid criteria but also to foster dialogue and sharing of experiences on best practices. The seminar will also intiate a joint writing project between the participants, where each teams explores one of the criteria and ultimately composes a review of its evolution and current state of the law. The resulting articles and notes will be developed with a view to publication in the European State Aid Law Quarterly.
